Even if you are abroad, you do not have to come to Turkey and attend court hearings if you have a lawyer. Your attorney will handle all necessary procedures on your behalf for both uncontested and contested divorce cases. Simply sending a power of attorney containing your photograph is sufficient.
Recognition and Enforcement of Foreign Divorce Decrees
In order for divorce decisions rendered abroad concerning Turkish citizens married to a Turkish or foreign national to be valid in Turkey, a recognition and enforcement lawsuit (Tanıma ve Tenfiz) must be filed.
Even if the parties are legally divorced abroad, they will still be considered married in Turkey unless a recognition/enforcement lawsuit is finalized. This situation causes difficulties in remarrying and means they will still legally inherit from each other.
Since recognition and enforcement cases are highly technical, they can take years if filed with incorrect/missing documents or improper procedures. Therefore, anyone who wants their divorce decision recognized and recorded in official registries as soon as possible should proceed with an expert lawyer.
How Do I Issue a Power of Attorney to My Lawyer?
If you are abroad, you can issue a lawyer power of attorney containing your photograph and authorization for recognition/enforcement from the Turkish Consulate or a local notary public in your country of residence.
If you have access to the consulate, we recommend issuing the power of attorney there rather than a notary. Since the power of attorney issued from the consulate will be in Turkish, you will not have to pay translation fees later.
Powers of attorney issued by foreign notaries must be translated into Turkish and annotated with an "Apostille" from the authorized institution.
